Grounds for Divorce

According to English law, there is only one recognised Ground for Divorce – when a marriage has irretrievably broken down. An irretrievable marriage breakdown could be the result of many factors, including but not limited to the following:

  • Adultery
  • Unreasonable Behaviour
  • 2 Years Separation with Consent
  • 5 Years Separation
  • Desertion

We strongly recommend obtaining expert legal advice at the earliest possible stage, as complications and delays in the process at a later stage can hinder progress and increase costs. With our legal team behind you, every aspect of the separation will be handled with the promptness, priority and professionalism you deserve.

Call anytime for an obligation-free initial consultation with Aristone Solicitors.

How Long Does it Take to Get a Divorce?

Some cases take longer to conclude than others, but a straightforward divorce with no specific complications will usually take around four to six months. There may also be delays when the relevant courts are busy or have a backlog, so we advise consulting with a qualified legal advisor at the earliest possible stage.

Depending on the circumstances surrounding the case, it may be advisable to delay your final divorce application until you have resolved any outstanding financial issues with your partner. In which case, we’ll advise as such and provide the support and representation you need.

Alternatives to Divorce

Judicial Separation is a possible though uncommon alternative to divorce, which is sometimes preferred by couples who would like to avoid divorce for religious reasons. In the case of Judicial Separation, the formalisation of the separation takes place in a similar way, though those involved are not permitted to remarry. If you’d like to discuss the specifics of Judicial Separation in more detail, call the team at Aristone Solicitors anytime.
