Receiving a claim form, usually the N1 Court Form, means that someone is suing you. Ignoring the claim form can lead to an automatic (default) Judgment against you, which can negatively impact your ability to get a job, mortgage, and even reduce your credit rating.
Things to Check First
- Verify the Claim: Ensure the claim is against you. Claims are sometimes sent to previous addresses, joint premises, or similarly named businesses. Confirm with the issuing court if you are the correct recipient.
- Proper Service: Check if the claim form was properly served, including a response pack. You must reply within 14 days of the service date. The response pack indicates which forms to use.
- Time Limits: Confirm if the claim was issued within the time limit. For example, breach of contract or tort claims (such as professional negligence) must be brought within 6 years, while libel and slander claims have a 1-year limit.
Dealing with the Claim
You have three options for responding to a claim:
- Admit the Claim: Complete and return Form N9A. Send the amount claimed, court fee, and interest to the claimant within 14 days.
- Partially Admit the Claim: Return Forms N9A and N9B. Clearly explain which parts of the claim you admit and dispute, with reasons.
- Defend the Claim: Complete and send Form N9B, detailing your reasons for contesting the claim.

Acknowledgement of Service
- Response Time: Notify the court within 14 days of how you plan to deal with the claim.
- Extended Time: Completing the acknowledgment of service gives you an additional 14 days to prepare your defense.
