Contingent Fee Arrangements

Depending on the nature and circumstances of your case, it may be possible to fund the required litigation on the basis of a contingent fee arrangement. These are sometimes referred to as “no win no fee” arrangements, which can reduce or even eliminate litigation costs for your business.

Under these agreements, all legal costs are payable by the other party (or parties) involved in the case, upon its successful conclusion. In the event that your case is unsuccessful, you would not be held liable for the legal fees incurred during the process. A contingent fee arrangement can also reduce your liability for covering your legal costs, without eliminating them entirely.

After the Event Insurance

An alternative option to consider is after the event insurance – also known as ATE. This is an insurance policy that can be taken out after contemplating litigation, which can reduce your requirements to pay the other party’s legal costs in the event that your case is unsuccessful.

After the event insurance can also cover some or all of the costs of the litigation process itself, depending on the specifics of the policy taken out.
