The cost involved in contesting a will depends on the nature of the dispute, the number of parties involved and the willingness of the parties to negotiate or compromise.
If the dispute can be resolved by mediation, the costs can be reduced. However, if the dispute goes to Court the costs will be much higher and potentially tens of thousands of Pounds. In some cases the costs incurred have exceeded the value of the estate. Hence, it is recommended that all parties attempt to resolve the dispute by mediation.
The solicitor and barrister (if the dispute reaches the court) will charge their regular hourly rates.
