What is Domestic Violence?

Remarkably, there’s currently no formal legal definition of domestic violence. According to the UK government, however, domestic violence refers to:

Any incident or pattern of incidents of controlling, coercive or threatening behaviour, violence or abuse between those aged 16 or over who are or have been intimate partners or family members regardless of gender or sexuality. This can encompass but is not limited to the following types of abuse:

  • Psychological abuse
  • Physical abuse
  • Sexual abuse
  • Financial abuse
  • Emotional abuse

Controlling behaviour is a range of acts designed to make a person subordinate and/or dependent by isolating them from sources of support, exploiting their resources and capacities for personal gain, depriving them of the means needed for independence, resistance and escape and regulating their everyday behaviour.

Coercive behaviour is an act or a pattern of acts of assault, threats, humiliation and intimidation or other abuse that is used to harm, punish, or frighten their victim.

As domestic abuse can be difficult to define, it can be equally difficult for those affected to know when and where their partners or family members have crossed the line. A situation that has led to millions ‘suffering in silence’ and accepting their situation.

Domestic violence and protection

The UK’s family Court can issues two types of injunctions, in order to protect victims of domestic abuse and domestic violence:

  1. an occupation order to exclude someone from your home
  2. a non-molestation order to prevent someone from being violent, threatening violence, harassing or intimidating you

The family court may issue one or both of these injunctions, as deemed appropriate for the case.

Who Can I Get an Injunction Against?

Both of the injunctions above can be filed against anyone you are considered to be ‘associated’ with, which covers spouses and former spouses, anyone you were engaged to, civil partners, same sex marriage partners, someone you were living with, the parent of your child, someone you had a long-term intimate relationship with and so on.

Should the injunction be breached by the abuser, the matter will be taken to the courts for further action to be taken against them.
